Terms of Use

These terms are the agreement between you and the developer of ShiftPay ("ShiftPay", "the app", "we") covering your use of the app. Using ShiftPay means you accept them, together with Apple's standard Licensed Application End User License Agreement, which governs your licence to the app itself. Where these terms add to that EULA, both apply.

What ShiftPay does

ShiftPay is an offline-first shift calendar and paycheck estimator for hourly workers in the United States. You record the shifts you work — by hand, from a saved template, from a repeating rotation, or by importing a photo of your posted schedule — and the app estimates what those hours should be worth, including overtime, unpaid breaks, differentials, and tips you enter yourself. It can also compare that estimate against a pay stub you type in.

ShiftPay produces estimates, not payroll. Every figure the app shows is a calculation based on the rates, rules, and hours you entered. It is not payroll advice, tax advice, or legal advice, and it is not a substitute for your employer's payroll system or for professional counsel. Overtime and wage law varies by state, city, industry, and contract, and it changes; the bundled rule presets are a good-faith convenience, not a legal determination. Before acting on a discrepancy — raising it with your employer, filing a wage claim, or making a financial decision — verify the numbers against your actual pay stub and, where it matters, with a qualified professional.

Your data is yours

Your schedule, employers, wage rates, and paycheck comparisons are stored in the app's private database. ShiftPay has no app account, and the developer does not host or receive that information. If you enable private iCloud sync, Apple stores a CloudKit copy in your iCloud account so your Apple devices can stay current; the developer cannot browse that private database. Keep an independent export if the data matters to you, because we cannot recover it. How the app handles local data, iCloud copies, and deletion is described in the Privacy Policy.

Availability and changes

ShiftPay is an independently developed app under active development. Features may be added, changed, or removed between versions, and support for older iOS releases may end. We aim not to break existing data, but we do not guarantee uninterrupted or error-free operation.

Disclaimers and limitation of liability

The app is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that any calculation, overtime rule preset, or scanned schedule is accurate or complete.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost wages, lost data, missed shifts, underpayment or overpayment, tax consequences, or employment disputes arising from your use of the app or from any estimate it produces. Where liability cannot be excluded, our total liability to you is limited to the amount you actually paid for ShiftPay in the twelve months before the claim. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and nothing here limits rights you have under mandatory consumer law.

Termination

You can stop using ShiftPay at any time by deleting the app; you can erase everything it stores first with Settings → Delete all data. We may discontinue the app or end your licence if you materially breach these terms.

Governing law

These terms are governed by the laws applicable where the developer resides, without regard to conflict-of-law rules, and any dispute will be brought in the courts of that place — except that you keep any right you have to bring a claim in your own place of residence under mandatory local consumer law. If any provision is held unenforceable, the rest stays in force.

Changes to these terms

We may update these terms. The current version always lives at this address with the date it was last updated; material changes will be noted in the app. Continuing to use ShiftPay after an update means you accept the revised terms.
